By entering this Promotion, entrants accept and agree to be bound by these Official Rules. Any violation of these rules may, at Sponsor’s discretion, result in disqualification. All decisions of the Sponsor regarding this Promotion are final and binding in all respects.
PROMOTION PERIOD First round: Nominations begin Wednesday, September 24, 2014 and ends Thursday, October 2, 2014. Voting round: Voting begins Friday, October 3, 2014 and ends Sunday, October 12, 2014. The winner will be announced Monday, October 13, 2014.
NOMINATORS AND VOTERS ELIGIBILITY Nominators and Voters for this voting contest (the “Promotion”) are open only to legal residents of the 50 UNITED STATES AND DISTRICT OF COLUMBIA who are at least 18 years old as of the date of entry, except officers, directors, members and employees of the Sponsor, or any other party associated with the development or administration of this Promotion, and the immediate family (i.e., parents, children, siblings, spouse), and persons residing in the same household, as such individuals.
PRIZE WINNER ELIGIBILITY This version of the voting contest (the “Promotion”) is open to elementary schools in the state of North Carolina only, or North Carolina schools that serve elementary school age children. Nominated schools of this voting contest (the “Promotion”) must be a North Carolina school that serves either a kindergarten through fifth grade, kindergarten through second grade, or third through fifth grade population. Nominated schools also must be one of the following: a North Carolina Public School, a North Carolina Licensed Charter School, a Registered Private School that is legally operating and listed in the North Carolina Directory of Non-Public Schools, or a Home School that is legally operating and registered with the North Carolina Department of Non-Public Schools. A maximum of 50 schools can be eligible for voting, so the contest is open to the first 50 schools nominated. The sponsor (numberdrummer.com) of this contest (“the Promotion”) has at the legal right to verify the credentials of the nominated schools and to reject a nomination at its own discretion.
HOW TO ENTER Visit numberdrummer.com or https://www.facebook.com/numberdrummer and follow the instructions to complete and submit a school for nomination.
If you do not have the requested social media account, you may nominate a school by sending an email to firstname.lastname@example.org with the subject line WIN a Number Drummer Session, your full name, and email address. All nominations become the property of the Sponsor and will not be acknowledged or returned. A maximum of 50 schools can be eligible for voting, so the contest is open to the first 50 schools nominated.
NOMINATION DETERMINATION WINNER SELECTION AND NOTIFICATION Nominations for the Number Drummer Live Interactive Session will be determined by nominations through Facebook and nominations received through the Number Drummer website. The final determination and decision will be made by the Sponsor (numberdrummer.com); Up to fifty schools maybe nominated, but only one will win a prize. The winning school will be determined as the nominated school that receives the most votes during the voting period.
One Winner- School with the most votes: One Number Drummer Live Interactive Session provided by Sponsor at the location of the winning school (Up to a $1000.00 Value - Varies due to travel because of location of winner). Session is approximately 60 minutes and provides hands-on interactive participation for up to 100 students as determined by the winner. The winning school may also choose to invite other students to observe and attend the session as audience members, but they will not be hands-on participants. If a school should choose to add additional sessions, it would be at the expense of the participating school at the normal session rate of the sponsor. Prize details, logistics, and accommodations will be agreed upon by both parties before prize is awarded. Winning school must agree to publishing on social media posts, email/newsletter mentions of Sponsor and this contest, newspaper, television, radio, online video hosting websites, sponsor’s website, and other forms of media outlets that may promote or report on the Sponsor and this contest. The Sponsor (numberdrummer.com) also understands that it must adhere to privacy laws regarding the video taping or photographing of a minor, and will not proceed without the written consent from the school, and/or parent or guardian. If the winning school has a student publishing policy in place, then written legal consent from the school will also serve as legal permission to publish. Certain accommodations may be met or agreed upon where video and photos only show the backs of students or in a certain way where the student could not be identified. The protection and privacy of each child is of the utmost importance. Prize is not transferable nor may be rescheduled once a scheduled date is set, unless uncontrollable circumstances arise such as inclement weather.
Any potential winner will be notified by email and/or telephone. If a potential winner: (i) cannot be contacted; (ii) does not respond within three (3) days from the date the Sponsor first tries to notify him/her; (iii) fails to return an Affidavit and Release; (iv) refuses the prize; and/or (v) the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the Promotion or receive the prize, and an alternate potential winner may be selected. Upon contacting a potential winner and determining that they have met all eligibility requirements of the Promotion, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared a “winner” of the Promotion.
TAXES. All federal, state and/or local income and other taxes, if any, are the winner’s sole responsibility.
ODDS OF WINNING. The odds of winning this Promotion depend on the number of eligible nominations received and votes received.
The Sponsor reserves the right to stop or restart the at anytime due to unforeseen circumstances beyond the sponsor’s control. Such circumstances could be, but not limited to, technical difficulties related to nominations, voting, and calculating of votes to determine a winner. If such unforeseen circumstances arise, then a random drawing will serve as the substitute system for determining a winner.
